Compensatory rest is equivalent time away from work provided when a worker cannot take a normal statutory rest period.
Compensatory rest replaces missed statutory rest
Compensatory rest is equivalent time off given when a worker cannot take a normal statutory rest period because a lawful exception applies. It is not extra annual leave, overtime pay or an informal promise to finish early someday.
It can arise in situations such as shift changes, split shifts, round-the-clock services, seasonal peaks, security work or an exceptional event. A relevant collective or workforce agreement can also change some rest arrangements. The GOV.UK compensatory-rest guide lists the main cases.
The replacement should match the rest that was missed. If only part of a break was lost, replace that part; if daily or weekly rest was displaced, identify the equivalent period rather than treating any later non-working time as sufficient.
Arrange it promptly and protect recovery
Decide when the replacement rest will happen as soon as the interruption is known. Place it close enough to the missed period to provide meaningful recovery, while checking the rule for the worker and the exception used.
Young workers have stricter protections and their permitted exceptions differ. Safety-critical work may also need more rest than the statutory replacement alone. Compensation does not remove the employer's duty to manage fatigue.
Record the reason, length and replacement
For each missed period, record the worker, planned rest, actual interruption, legal or agreed reason, equivalent rest given and date taken. This makes repeated exceptions visible and prevents the same missed rest being counted twice.
If compensatory rest becomes routine, review staffing and rota design. The exception is there to handle particular working arrangements or events, not to support a schedule that is predictably short of cover. Apply Northern Ireland's separate working-time rules to NI workers.
