Pension opt-in and joining are worker rights to request pension membership when automatic enrolment has not put them into a scheme.
Opting in and joining create different duties
Pension opt-in and joining cover staff who have not been put into a scheme through automatic enrolment. A jobholder can give an opt-in notice requiring membership of an automatic enrolment scheme. An entitled worker can give a joining notice requiring the employer to arrange membership of a pension scheme.
The contribution result differs. When a jobholder validly opts in, the employer must contribute under the automatic-enrolment rules and scheme terms. When an entitled worker joins, the employer does not necessarily have a statutory contribution duty. The Pensions Regulator's membership guidance explains both routes.
Reassess when the request arrives
Treat a clear request as something to process, not as an informal benefits question. Check that the notice meets the current requirements, then assess the worker's category using their circumstances at the relevant time. That decides whether the request is an opt-in, joining request or an automatic-enrolment case that must follow the automatic route.
Arrange membership, give the required information and start any contributions from the correct date. The regulator's information guidance sets out what each category must be told.
Do not confuse a statutory request with contractual enrolment
An employer may offer broader pension membership through employment terms. That is contractual enrolment and normally relies on the worker's agreement to membership and deductions. It does not replace the statutory assessment or remove later automatic-enrolment duties.
Keep the request, category assessment, scheme action, worker information and payroll start together. A record that says only “joined pension” hides whether contributions and notices followed the correct route.
