A sleep-in is not an ordinary night shift

A sleep-in shift requires a worker to remain at or near the workplace, usually overnight, while being permitted and expected to sleep for most or all of the period. Suitable sleeping facilities are part of that distinction. A worker expected to stay awake and perform duties through the shift is doing night work, even if quiet periods allow an occasional nap.

Minimum wage follows what happened

For minimum-wage purposes, a genuine sleep-in worker with suitable facilities is generally entitled to minimum wage for time when they are awake for the purpose of working, not simply every hour they are permitted to sleep. If the person is expected to work for most of the shift, lacks suitable sleeping facilities or is woken so often that the arrangement no longer operates as a sleep-in, the position can change.

Record every interruption

Write down the expected duties, sleeping facilities, contractual payment and response arrangements. For each shift, record when the worker was woken, why, the work performed and when it ended. Repeated interruptions are operational evidence, not merely payroll detail.

Review the arrangement if waking work becomes frequent or facilities change. Check rest after the shift as well as pay during it. Use separate Northern Ireland guidance for an NI role.
