Volunteering must remain voluntary in practice

A volunteer gives time freely without a contract requiring personal work in return for pay or another reward. They can normally choose when to help and stop without a contractual sanction. That freedom matters more than the heading on a volunteer agreement.

A simple agreement can explain the role, expenses, support and conduct expected, but it should describe reasonable expectations rather than promise work or impose employee-style obligations. Regular compulsory shifts, sanctions for non-attendance, payment, benefits or a promised job can point towards worker status and minimum-wage rights.

Expenses should repay a real cost

Volunteers can be reimbursed for costs such as travel, food or equipment needed for the role. Keep receipts or a reasonable method for estimating the expense. A flat payment that regularly exceeds what the person spends can look like reward rather than reimbursement.

Do not confuse a volunteer with a voluntary worker. A voluntary worker has a contract to perform work but can fall within a specific minimum-wage exemption when working for certain charities, voluntary organisations, fundraising bodies or statutory bodies and receiving only permitted expenses and benefits. The minimum-wage eligibility guidance sets out that narrower category.

Give clarity without creating a job by accident

Record a short role description, named contact, safeguarding or confidentiality requirements, insurance arrangements and how expenses are claimed. Avoid language about wages, compulsory hours, holiday entitlement or disciplinary sanctions unless the organisation intends to create a working relationship.

Review the arrangement if the volunteer starts covering regular staff work, receives new benefits or loses the practical freedom to say no. A role can begin genuinely voluntary and become worker-like as its expectations change.
