Protected characteristics
Protected characteristics are the nine personal characteristics covered by the Equality Act 2010 against unlawful discrimination in Great Britain.
The nine characteristics in Great Britain
The Equality Act 2010 list explained by Acas covers:
- age
- disability
- gender reassignment
- marriage and civil partnership
- pregnancy and maternity
- race
- religion or belief
- sex
- sexual orientation
Protection can matter before someone joins, throughout their working relationship and after it ends. Recruitment, pay, training, promotion, working arrangements, discipline, dismissal and references can all involve decisions where discrimination law applies.
The list is not identical across the UK
“The nine protected characteristics” is a Great Britain shorthand. Northern Ireland does not use the Equality Act 2010 as one combined framework. Its separate laws cover overlapping grounds and also address religious belief and political opinion in their own way. The nidirect discrimination overview is the safer starting point for a Northern Ireland worker or workplace.
Use the characteristics as a decision check
Managers do not need protected-characteristic information for every routine decision. They do need fair, job-relevant criteria and a way to notice when a policy or choice may disadvantage someone unlawfully.
Before advertising a role, changing a rule or choosing an outcome, ask what evidence supports the decision, whether the same standard is being applied consistently and whether the rule affects a protected group differently. Keep equality-monitoring information separate from the people making recruitment decisions. If disability may be involved, consider reasonable adjustments rather than treating identical treatment as automatically fair.
The practical aim is not to label people. It is to make better decisions and spot where a neutral-looking process could create an unlawful disadvantage.
